I am confirming by this email that I am in receipt of your request to be placed on the upcoming City Council Agenda to address the Council regarding the Advertising & Promotion Tax.

However, I do not believe it would be appropriate for you to address the City Council at this time since you represent the Plaintiffs of pending litigation with the City of Searcy concerning this very issue.

Therefore, I am denying your request.

I do not intend to attack the Honorable Mayor or the Council…  just would like the opportunity to give some insight as to a good number of citizens’ view of what action the council should consider taking on the Advertising and Promotion legislation and the rational behind their view.

The Mayor’s stance would prohibit any political speech, expression or discussion of citizens and the Council relative to the A & P measure to only political speech, expression or discussion supportive of the A & P Measure, which seems violative of the 1st Amendment and any ideal of fair dealing.

All I would like to do is address the Council and articulate the views (in a very respectfully way) of a large number of Searcy Citizens and the Rational behind these views and then make a simple plea that the Council consider calling an election.

I give you my word that I will not scream, I will not use demeaning words against the Mayor or any Council Member, I will not question the council (other than pose rhetorical questions when making the plea to the council) I will merely articulate the Citizens views, rational, make a plea…. then sit down.

I would respectfully request the Mayor re-consider her position on this important matter and place me on the Agenda for the purposes indicated above.

Buck….   Sorry, I think I left out a word in the 3rd paragraph of the e-mail.  It should read as follows:

Additionally, (I know you know how to find it, but for your convenience), here is the First Amendment of the United States Constitution

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

This request is merely to peaceably petition the City Council for redress of a grievance.

City Clerk/Treasurer, Peggy Meads, advises that I am on the Agenda.

I will see you Tuesday at the City Council Meeting.
